Texas Drug Schedules and Penalties

Texas classifies controlled substances into penalty groups, which are similar to the federal schedule system. These groups determine the severity of charges and potential penalties.

Penalty Group One: Includes opioids (heroin, oxycodone), cocaine, methamphetamine, and ketamine.

  • Less than one gram: State jail felony, 180 days to two years in state jail, up to $10,000 fine
  • One to four grams: third-degree felony, two-10 years in prison, up to $10,000 fine
  • Four-200 grams: second-degree felony, two-20 years in prison, up to $10,000 fine
